1) Scope

1.1 These General Terms and Conditions (hereinafter “GTC”) of Dinar Shop (hereinafter “Seller”) apply to all contracts for the delivery of goods concluded between a consumer or entrepreneur (hereinafter “Customer”) and the Seller regarding the goods presented in the Seller’s online shop. Any inclusion of the Customer’s own terms and conditions is hereby rejected unless otherwise agreed.

1.2 A consumer within the meaning of these GTC is any natural person who concludes a legal transaction for purposes that are predominantly neither attributable to their commercial nor independent professional activity.

1.3 An entrepreneur within the meaning of these GTC is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.


2) Conclusion of the Contract

2.1 The product descriptions in the Seller’s online shop do not constitute binding offers but serve as an invitation for the Customer to make a binding offer.

2.2 The Customer can submit an offer via the online order form integrated into the Seller’s online shop. After selecting the goods and completing the electronic ordering process, the Customer submits a legally binding contract offer by clicking the order completion button. The Customer may also submit the offer via email, online contact form, or phone.

2.3 The Seller may accept the Customer’s offer within five days:

  • By sending a written order confirmation or confirmation via email, where the receipt of the confirmation by the Customer is decisive.
  • By delivering the ordered goods to the Customer, where the receipt of the goods is decisive.
  • By requesting payment from the Customer after the order is placed.

If multiple acceptance options exist, the contract is concluded at the moment when one of these occurs first. If the Seller does not accept the offer within this period, the Customer is no longer bound by their declaration of intent.

2.4 If a payment method via PayPal or Stripe is selected, payment processing is carried out by the respective service provider under their terms and conditions.

2.5 The contract text is stored by the Seller and sent to the Customer in text form (e.g., email) after the order is placed. If the Customer has created a user account, the order data will be archived and accessible via their password-protected account.

2.6 Before submitting an order, the Customer can identify input errors by carefully reviewing the displayed information and using standard correction functions.

2.7 The contract language is English.

2.8 Order processing and communication are conducted via email. The Customer must ensure that the provided email address is correct and able to receive messages from the Seller.


3) Right of Withdrawal

3.1 Consumers generally have a right of withdrawal.

3.2 Further details on the right of withdrawal can be found in the Seller’s cancellation policy.


4) Prices and Payment Terms

4.1 Unless otherwise stated, all prices include statutory sales tax. Any additional delivery and shipping costs are specified separately.

4.2 For deliveries outside the European Union, additional costs such as transfer fees, currency exchange fees, import duties, and taxes may apply, which are borne by the Customer.

4.3 The available payment methods are displayed in the Seller’s online shop.

4.4 If advance payment by bank transfer is chosen, payment is due immediately unless otherwise agreed.


5) Delivery and Shipping Conditions

5.1 Delivery is made to the address provided by the Customer unless otherwise agreed.

5.2 If delivery fails due to reasons attributable to the Customer, the Customer shall bear the costs incurred.

5.3 If the Customer is an entrepreneur, the risk of accidental loss or deterioration of the goods passes to the Customer once the Seller delivers the goods to the carrier. If the Customer is a consumer, the risk passes upon receipt of the goods.

5.4 The Seller reserves the right to withdraw from the contract in case of non-availability of the goods due to reasons beyond their control.


6) Retention of Title

If the Seller makes advance payments, the Seller retains ownership of the delivered goods until full payment is received.


7) Liability for Defects (Warranty)

Unless otherwise specified, statutory warranty rights apply.

7.1 For entrepreneurs, the limitation period for new goods is one year from delivery, and warranty claims for used goods are excluded.

7.2 These limitations do not apply in cases of intentional misconduct, fraudulent concealment, or mandatory liability under applicable laws.

7.3 Entrepreneurs must comply with their obligation to inspect and report defects in accordance with the applicable commercial laws.


8) Liability

8.1 The Seller is liable without limitation for:

  • Intentional or gross negligence
  • Injury to life, body, or health
  • Any legal guarantee obligations
  • Mandatory liability under product liability laws

8.2 In cases of simple negligence, the Seller is liable only for breaches of material contractual obligations.

8.3 The Seller’s liability is otherwise excluded.


9) Redemption of Promotional Vouchers

9.1 Promotional vouchers are only valid within the specified period and cannot be purchased.

9.2 Vouchers can only be redeemed in the Seller’s online shop before completing the order.

9.3 A voucher’s remaining balance is not refundable.

9.4 If the order total exceeds the voucher value, the Customer must pay the difference using an available payment method.


10) Applicable Law

The laws of the Federal Republic of Germany apply, excluding international sales laws. For consumers, this applies only if mandatory consumer protection regulations in their country of residence are not violated.


11) Code of Conduct

The Seller adheres to the eCommerce initiative “Fairness in Trade” and the Trusted Shops quality criteria.


12) Alternative Dispute Resolution

12.1 The EU provides an online dispute resolution platform: https://ec.europa.eu/consumers/odr

12.2 The Seller is neither obliged nor willing to participate in dispute resolution before a consumer arbitration board.
